By placing an order, you are confirming you are at least 18 years old. All orders shall be considered as requests to purchase goods from Alex Marton Fine wines until confirmed. We may choose not to accept an order, at our discretion.
2) Price and payments
Prices on our website are quoted per case (Unit) as packed. Either as ‘In Bond’ or ‘Duty Paid excluding VAT’. In Bond wines may only be purchased where the wine is to be transferred to another bonded warehouse or be exported outside of the EU by a shipper who has a Movement Guarantee. For all other orders, we are obliged to process as Duty Paid and charge UK Duty and VAT. VAT must be applied to both the value of the wine and the Duty. UK Duty and VAT rates are subject to change and the prevailing rates will be used at the time the wine becomes available for delivery to you.
All prices are subject to our final written confirmation, accepting your order. Whilst we take all reasonable steps to ensure prices on our website are correct and up-to-date, there may be occasions where errors occur. In such instances, we will not be obliged to sell the wine at the incorrect price. We reserve the right to change our prices.
Payment is due upon invoice, unless otherwise agreed.
All wines remain the property of Alex Marton Fine wines (other than goods in your direct physical possession following delivery or collection and payment in full for those goods) until payment is received in full. Risk in all goods shall pass to you as soon as we notify you that they are available and earmarked under your order. If goods within our ownership are held by any third party on your behalf you will upon our request instruct that third party to hold the goods to our order.
Prices do not include a delivery charge which is free on orders over £500. Delivery charges will be charged at the following rates
Within the M25 delivery: £17 + VAT for 1 – 20 cases.
Transfer to LCB Bond warehouse: £10.50 + VAT for 1 – 20 cases.
All deliveries made outside the M25 will be quoted and charged on an individual basis.
Orders will be dispatched to your nominated delivery address in accordance with the delivery notification given at the time of Order.
When an order is placed, we will give you an estimated delivery date. Any such estimate is not intended to be legally binding and may be subject to revision. If you wish to change the delivery address and or date you may do so by notifying us in advance. Any changes may incur extra charges for the delivery.
Once we have notified you that wines are available for delivery / collection; we require you to accept delivery or make collection within one month. Failure to make such arrangements will result in us applying our standard monthly storage charges.
We will make every effort to deliver on the day and time agreed with you. If you are not present to accept delivery at the agreed time, the goods will be returned to our warehouse and you will need to request and make payment for a new delivery.
You undertake to inspect all goods when collecting or immediately on delivery and to notify us or the carrier immediately of any shortage, damage or other deficiency.
You will be deemed to have accepted the goods after a period of 14 days, and thereafter will not be entitled to reject products for any reason, and no returns or credits will be permitted thereafter.
6) Consumer Cancellation & Returns
You have a period of 14 days from the day after the date of receipt by you or your agent of the goods in which to withdraw from the contract. The only charge that may be made to you exercising the right of withdrawal is the direct cost of returning the goods, provided that you have taken reasonable care of the goods.
Wines purchased En Primeur are excluded from the above right to withdraw.
In the event of a cancellation, a full refund will be made within 14 days of us receiving the goods in the same condition they were delivered.
How to Cancel:
In order to cancel a Contract, you must contact Alex Marton Fine Wines in writing, either by email or letter sent to our registered company trading address.
Without prejudice to the foregoing none of the goods are supplied on a “sale or return” basis.
Alex Marton Fine Wines takes no responsibility for wines that are faulty or corked.
With respect to older or high-value wines we will make reasonable efforts to verify the provenance of such wines but we cannot guarantee the authenticity or quality of the wine in the bottle. Older wines may age and mature in different ways, and some wines may deteriorate in quality. Opinions as to authenticity and provenance will vary and in many cases even following scientific testing and detailed research it is not possible to establish the authenticity or provenance of a given wine definitively.
Our liability in any circumstances under or in connection with any sale of wines will be limited to the purchase price paid by you for the wines.
We will not be liable for any indirect or consequential losses or damages, lost profit, lost reputation, and loss of anticipated savings.
We will not be liable to you or to any other party following the onward sale of wines by you.
8) Force Majeure
We shall not be liable for any failure to meet our obligations occasioned if the failure or delay is the result of circumstances beyond our reasonable control.
9) Changes to Terms & Conditions
We may, from time to time, make changes and revisions to these Terms and Conditions. The Terms and Conditions which are current at the time of order will be applied. We will apply a new date to this document when amending.
9) Governing Law & Jurisdiction
These Terms and Conditions will be subject to English law and the jurisdiction of the English Courts.
